On June 24, 2022, the Decision on Revising the Anti-Monopoly Law of China was passed and will come into effect on August 1, 2022. At the same time, the State Administration of Market Regulation (“SAMR”) published 6 supporting regulations drafts for public comments, including an administrative regulation of the State Council and five departmental regulations of the SAMR, covering monopoly agreements, abuse of dominant position, intellectual property rights, concentration of undertakings and administrative monopolies. New competition rules are brought by crucial revisions such as the significant increase in fines, important changes in the control of concentrations and the regulation of vertical monopoly agreements, the involvement of the People’s Procuratorate in public interest litigation, etc. The revision leaves many practical questions to be answered: (1) How to adapt the management of distributors and limits of resale price to the new rule for enterprises? (2) Is the historical failure to notify in accordance with the law facing significantly increased new fines? (3) How to anticipate the legal risk of fines up to 50% of the group’s turnover? (4) For enterprises, what does the new law provided and not provided?
We’ve invited Professor Huang Yong, a leading authority in China, to systematically review the new Anti-Monopoly Law, and Jet Deng and Ken Dai, specialist lawyers from Dentons Antitrust Team, to discuss the above practical issues based on market competition scenarios and business aspects.

Dr. Deng received his PhD degree in International Economic Law from the University of International Business and Economics (UIBE) and is the Chair of Dentons China Competition and Antitrust Practice.
Dr. Deng has been consecutively recognized by Chambers & Partners as one of the “Leading Lawyers for Antitrust Practice in Asia-Pacific” for nine years (2014~2022). Dr. Deng is a member of the Merger Control Experts Panel of the International Chamber of Commerce (ICC) on Competition Commission, a legal associate of the Competition and Regulation European Summer School and Conference (CRESSE), a member of China Consumers Association’s lawyer group and also a member of the anti-monopoly expert panel of the Beijing Municipal Administration for Market Regulation.

Mr. Dai is the Chair of Competition and Antitrust Practice of Dentons Shanghai Office.
Mr. Dai is one of the first lawyers to practice Anti-Monopoly law in China and has over 15 years of experience in this area. Mr. Dai has been consecutively recognized as one of "The Legal 500 Asia Pacific Antitrust and Competition Lawyers" (2019-2020).

2022年6月24日,《反垄断法(修正案)》获得通过,并将于8月1日开始施行。与此同时,国家市场监管总局公布六部配套法规征求意见稿,包括一部国务院行政法规草案与五部总局部门规章,涉及垄断协议、滥用市场支配地位、知识产权、经营者集中与行政垄断。处罚力度的大幅提升、经营者集中制度的重要变革、纵向垄断协议规制变化,以及检察院介入公益诉讼,这些重要修订将带来全新的竞争规则。新法带来诸多亟待回答的实务问题:(1)企业的经销商管理、转售价格限定如何调整适应?(2)历史上的未依法申报交易是否面临大幅加重的新罚则?(3)最高罚款可达集团营业额50%的法律风险如何预判?(4)对企业而言,新法说了哪些,又有哪些欲言又止之处?
我们邀请了国内权威学者黄勇教授对新反垄断法进行系统评述,并由大成反垄断团队的邓志松律师和戴健民律师基于市场竞争场景和业务环节,对上述实务问题进行讨论。
